Terms of Service
The agreement that applies when you create an account and use WAYA.
Last updated: 30 July 2026 • Effective: 30 July 2026
1. Agreement
These Terms govern your use of WAYA. By creating an account you agree to them. If you don't agree, don't use WAYA.
2. Who can use WAYA
You must be at least 13 years old (and the age of digital consent in your country) to use WAYA. You must provide an email address you control and verify it before using an email/password account.
3. Your account
- One account per person.
- Use a strong, unique password and keep your email account and devices secure. If your account is taken over because you shared credentials or failed to protect your email or device, you may be responsible for resulting activity.
- You can delete your account at any time in Profile/Settings → Delete account. If you cannot access the app, follow the verified-email support process on our account deletion page.
4. Acceptable use
You agree not to use WAYA to:
- Send spam, harass, threaten, dox, or incite violence.
- Distribute child sexual abuse material — we report immediately to law enforcement and NCMEC.
- Impersonate someone else.
- Reverse-engineer, scrape, or interfere with our infrastructure.
- Use WAYA for any unlawful purpose under Ghanaian, Nigerian, or applicable law.
We can suspend or terminate accounts that violate these rules. We have no obligation to host any specific content or user.
5. Your content
You own everything you send. By sending it through WAYA you grant us the limited rights necessary to operate the service, including storing and processing content on our infrastructure and private object-storage provider, routing it through our service providers, and delivering it to recipients. Current messages and uploaded media are not application-layer end-to-end encrypted and can be processed by WAYA's servers. Traffic is protected in transit with TLS; customer media is encrypted at rest when stored in Backblaze B2; WAYA's self-hosted LiveKit service uses WebRTC transport encryption for calls. Application-layer E2EE is planned but is not currently available.
6. Free service
- WAYA does not offer paid plans, subscriptions, or paid feature tiers.
- All currently available product features are included with a WAYA account.
- WAYA does not require a payment method to use the service.
- Your carrier or internet provider may charge for data or SMS under its own terms; WAYA does not collect those charges.
7. Service availability
WAYA is provided "as-is" and "as-available". We work hard to keep it up but we make no uptime guarantee. Voice calls require cellular or Wi-Fi connectivity — if your network drops the call, that's not our fault.
8. Disclaimers
To the maximum extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
Our total liability to you for any claim related to WAYA is capped at USD 50. We aren't liable for indirect, incidental, or consequential damages.
This doesn't limit liability that can't be excluded by law (death, personal injury, fraud).
10. Governing law
These Terms are governed by the laws of Ghana. Disputes go to the courts of Accra, unless local consumer law gives you a stronger right.
11. Changes
We may update these Terms. Material changes get 14 days' in-app notice. Continued use after the effective date means you accept the new Terms.
